1. Acceptance of Terms
By creating an account, accessing, or otherwise using TripAI, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
TripAI is an AI-powered travel planning platform that enables users to generate personalised trip itineraries through natural language input. The Service includes features for discovering destinations, saving and sharing itineraries, tracking travel budgets, and collaborating with travel companions. The Service is provided “as is” and we reserve the right to modify, suspend, or discontinue features at any time with reasonable notice.
3. Eligibility
You must be at least 16 years of age to use TripAI. If you are between 16 and 18, you represent that you have obtained consent from a parent or legal guardian. By using the Service, you represent and warrant that you meet these age requirements and that you are not barred from receiving services under applicable law.
4. User Accounts
To access personalised features, you must create an account. You are responsible for:
- Providing accurate and current information during registration and keeping it up to date.
- Maintaining the confidentiality of your password and restricting access to your account.
- All activity that occurs under your account, whether or not authorised by you.
- Notifying us immediately at legal@tripai.live if you suspect unauthorised access.
We reserve the right to terminate or suspend accounts that violate these Terms, provide false information, or remain inactive for an extended period. You may delete your account at any time from your account settings.
5. Acceptable Use
You agree to use TripAI only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable local, national, or international law or regulation.
- Transmit unsolicited promotional communications or engage in scraping, data mining, or automated bulk access without our written consent.
- Attempt to gain unauthorised access to any part of the Service, its servers, or connected databases.
- Upload, transmit, or share content that is defamatory, obscene, threatening, discriminatory, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with a person or entity.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to generate content that facilitates illegal activity or harms any person.
- Introduce malware, viruses, or any other malicious code into the Service.
We reserve the right to investigate and take action against any violations, including removing content and terminating accounts.
6. AI-Generated Content
TripAI uses AI models to generate trip itineraries and travel recommendations. You acknowledge and agree that:
- AI-generated itineraries are suggestions only and may contain inaccuracies, outdated information, or errors.
- Flight prices, hotel availability, visa requirements, and safety conditions must always be independently verified before making bookings or travel decisions.
- We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.
- You assume all responsibility for relying on AI-generated suggestions without independent verification.
7. Intellectual Property
The Service and its original content, features, and functionality — including but not limited to the TripAI name, logo, software, user interface, and AI models — are and will remain the exclusive property of TripAI and its licensors. They are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial trip planning purposes. This licence does not include any right to resell, reproduce, distribute, or create derivative works based on the Service or its content.
8. User Content
You retain ownership of any content you submit, post, or upload to the Service (“User Content”), including trip descriptions, photos, and reviews. By submitting User Content, you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, display, and distribute it solely to operate and improve the Service.
You represent and warrant that your User Content does not infringe any third-party rights and that you have all necessary rights to grant the above licence. We reserve the right to remove any User Content that violates these Terms.
9. Third-Party Services
The Service may contain links to or integrations with third-party websites, APIs, or services (e.g. flight booking platforms, map providers). These are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party service. Accessing third-party services is at your own risk.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We do not endorse, guarantee, or assume responsibility for any travel service, booking, or third-party recommendation accessed via or suggested by the Service. Travel involves inherent risks, and you are solely responsible for your travel decisions and safety.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRIPAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRIPAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the greatest extent permitted by applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless TripAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or if we determine, in our sole discretion, that your use of the Service poses a risk to TripAI, other users, or third parties.
You may terminate your account at any time by deleting it via account settings. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, liability limitations, and indemnification — will continue to apply.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TripAI is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes will be subject to binding arbitration or the exclusive jurisdiction of the courts of that jurisdiction.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email (if you have an account) and by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.
